First Reading of an Ordinance Relating to Fireworks <br />Kysylyczyn moved, Kough seconded holding First <br />Reading of an ordinance entitled, "An Ordinance <br />amending Title Five, Sections 504.01 and 504.05, <br />Fireworks. " <br /> <br />City Attorney Anderson responded to Mayor <br />Kysylyczyn's concerns regarding Minnesota Statute <br />language and repetitive City Code language; with City <br />Attorney Anderson attempting to clarify City Code <br />language, specifically regarding defining "combustibles," <br />and seizure issues, in order to make the Code consistent <br />with State and Federal law for enforcement purposes. <br /> <br />City Attorney Anderson was not able to respond to all of <br />Mayor Kysylyczyn's concerns without further research. <br /> <br />After further discussion, Kysylyczyn withdrew his motion, <br />and Kough withdrew his second. <br /> <br />Kysylyczyn moved, Schroeder seconded directing staff to <br />return with a revised ordinance that would strike or amend <br />the various sections necessary to address those items <br />unique to the City, and yet provide consistency with State <br />and Federal legislation. <br /> <br />Roll Call <br />Ayes: Schroeder, Maschka, Kough and Kysylyczyn. <br />Nays: None. <br /> <br />C. First Reading of an Ordinance Relating to Peddling <br />and Solicitation <br />Kysylyczyn moved, Schroeder seconded First Reading of <br />an ordinance entitled, "An Ordinance Amending Title <br />Five, Section 407.02(H), Nuisances," with the City <br />Attorney directed to provide additional language on Page <br />2, Item 2 to include insertion of "No Trespassing" signs. <br /> <br />Roll Call <br />Ayes: Schroeder, Maschka, Kough and Kysylyczyn. <br /> <br />First Reading of an <br />Ordinance Relating <br />to Fireworks <br />(to be revised) <br /> <br />First Reading of an <br />Ordinance Relating <br />to Peddling and <br />Solicitation <br />(to be revised) <br />
