The second amendment occurred in February 2004, which made a number of text updates and converted permitted and conditional use text into a chart. Discussion included staff s confidence that discrepancies had been identified and further amendment would not be required, or if further review was prudent; the inclusion of live entertainment; and potential for further refinement. [5.1] Maschka moved, Klausing seconded, approval of the change in the Business District Chart (Section 1005.015) pertaining to restaurants - specifically allowing a Class III - Traditional with Intoxicating/Non-Intoxication (3.2 beer, wine and/or strong beer) as a PERMITTED USE; a Class IV - Traditional w/On-Sale Liquor Service (full service bar) with takeout/deli as accessory use - no live entertainment or dancing as a PERMITTED USE; and a Class IV - Traditional w/On-Sale Liquor Service (full service bar) with live entertainment or dancing as a CONDITIONAL USE." Councilmember Ihlan requested as a future agenda item, inclusion of discussion of code language related to models/dancers and rationale for deleting it from the code; and whether it was due to language addressed in the Sexually Oriented Business code provisions.
