<br />Regular City Council Minutes -10/14/02 <br />Minutes - Page 8 <br /> <br />the Council's support of the City Manager's appointment <br />and the alleged personal attacks on Mr. Jamnik's <br />reputation and character. <br /> <br />Mayor Kysylyczyn noted for the record that he didn't <br />reference personalities in his four issues. <br /> <br />Councilmenlber Klausing and Mayor Kysylyczyn <br />continued debate on the appointment process. <br /> <br />Councilnlember Maschka interjected a historical <br />perspective on why former City Council's chose a six <br />year, rather than a three year RFP process, in order to <br />allow development of expertise and knowledge of the <br />respective city and its preferred processes, as well as the <br />expenses incurred by the City in instituting a forced <br />learning curve for each new finn every three years. <br /> <br />Councilmember Schroeder expressed his appreciation for <br />Councilmember Maschka's perspective, but reiterated his <br />opinion that he was not supportive of continuing with the <br />same legal firm. <br /> <br />City Manager Beets responded to several point brought up <br />by Mayor Kysylyczyn during the discussion. <br />1) Regarding rankings of the respective firms, City <br />Manager Beets stated that every member of the <br />interview panel agreed with the final rankings and <br />participated in the rankings, with a staff report sent <br />to each of them in advance and their agreement with <br />the rankings; that there were no apparent divisions <br />among panel members. <br />2) With respect to the four issues raised by Mayor <br />Kysylyczyn, City Manager Beets responded that the <br />client has some say in the decision-making with <br />respect to a specific course of action; and that it was <br />a mistake to attribute to the law firm the course of <br />action they've been directed to perform by the <br />client; that the client makes the final decision. <br />3) With respect to the court decisions; in each case, <br />sonleone loses and someone wins in any judge <br />
