Mayor Kysylyczyn noted for the record that he didn't reference personalities in his four issues. Councilmenlber Klausing and Mayor Kysylyczyn continued debate on the appointment process. Councilnlember Maschka interjected a historical perspective on why former City Council's chose a six year, rather than a three year RFP process, in order to allow development of expertise and knowledge of the respective city and its preferred processes, as well as the expenses incurred by the City in instituting a forced learning curve for each new finn every three years. Councilmember Schroeder expressed his appreciation for Councilmember Maschka's perspective, but reiterated his opinion that he was not supportive of continuing with the same legal firm. City Manager Beets responded to several point brought up by Mayor Kysylyczyn during the discussion. 1) Regarding rankings of the respective firms, City Manager Beets stated that every member of the interview panel agreed with the final rankings and participated in the rankings, with a staff report sent to each of them in advance and their agreement with the rankings; that there were no apparent divisions among panel members. 2) With respect to the four issues raised by Mayor Kysylyczyn, City Manager Beets responded that the client has some say in the decision-making with respect to a specific course of action; and that it was a mistake to attribute to the law firm the course of action they've been directed to perform by the client; that the client makes the final decision. 3) With respect to the court decisions; in each case, sonleone loses and someone wins in any judge
