Bus Shelter Request for Proposals (RFP's)/Franchise <br />Community Development Director Dennis Welsch <br />introduced a proposed general ordinance authorizing the <br />City to grant non-exclusive transit shelter franchises for <br />Council consideration. <br /> <br />Ci ty Attorney Squires advised that the draft ordinance had <br />been prepared for Council review, with research having <br />been initiated by the former City Attorney. <br /> <br />Mayor Kysylyczyn expressed concern, with agreement by <br />Councilmembers, that there was minimal information <br />presented, making an informed decision difficult. <br /> <br />Public Works Director Duane Schwartz stated that no <br />designs had been completed yet, and that staff was only <br />looking at general direction from the Council at this time. <br /> <br />Discussion included a franchise ordinance versus a <br />contract with each individual vendor; impact of such an <br />agreement on existing shelters around town and existing <br />benches at bus stops; proximity distance between benches <br />and/or shelters; length of lease time (20 years); period of <br />time required for the vendor to recoup their cost and <br />realize a return on their investment; staff report <br />establishing the pros and cons of an ordinance versus a <br />contract; and First Amendment rights versus advertising <br />restrictions listed in the draft ordinance. <br /> <br />City Attorney Squires summarized the intent of the <br />general ordinance and answered Council questions.
