<br />Regular City Council Minutes - 12/09/02 <br />Page 6 <br /> <br />within the City. <br /> <br />City Manager Beets clarified that the issue under <br />discussion was to replace the high power transmission <br />lines supported by lattice towers with a monopole tower, <br />not to underground the high power transmission lines. <br /> <br />As requested by Councilmembers, Ms. Jurek provided a <br />more detailed explanation of the special facilities <br />surcharge. <br /> <br />Ms. Jurek cited a court case involving the City of Oakdale <br />and Xcel Energy where the courts determined that a utility <br />can be directed to bury distribution facilities, but the city is <br />responsible for incremental costs. Ms. Jurek stated that <br />experience has proven that in burying underground lines, <br />you have fewer numbers of outages, but they last longer as <br />it's more difficult to determine where a problem is. Ms. <br />Jurek specified that the undergrounding of transmission <br />lines has not been addressed in the courts yet. <br /> <br />Mr. Schwartz stated that the Public Utilities Commission <br />established the tariff to obtain additional funding for <br />benefiting the community. <br /> <br />Ms. Jurek advised Councilmembers that, at their request, <br />she would be available to attend the public hearing on <br />undergrounding the County C electric distribution lines <br />within the right-of-way when it is scheduled. <br /> <br />Discussion ensued among Councilmembers regarding <br />clarifying the immediate direction to staff and whether the <br />intent of the motion was clear as stated. <br /> <br />Roll Call <br />Ayes: Klausing, Kough, Schroeder, Maschka and <br />Kysylyczyn. <br />Nays: None. <br /> <br />VII.
