City Council Regular Meeting - 10/23/06
Minutes - Page 19

Further discussion ensued as to preferences for the City Council
meeting individually or as a body for interviewing purposes.

Staff advise that both the October 31 and November 16, 2006
meetings would be noticed as public meetings.

Mayor Klausing expressed his preference for City Council
interviews, the forum, and one-on-one meetings with each
candidate by individual Councilmembers.

Councilmember Maschka concurred with individual interviews,
rather than in a more formal environment; and then to hold
discussions in an open meeting.

City Attorney Anderson cautioned that he would need to review
recent case law to determine the Open Meeting law and serial
interview perceptions prior to providing legal counsel on the
appropriateness of individual interviews.

Mayor Klausing advised that, with the previous City Manager
vacancy, each candidate rotated through each Councilmember,
with each Councilmember having an opportunity to personally
interview each candidate while being very conscious about not
talking about the applicants until they came back together as a
group.

Ms. Bacon reviewed the interview schedule from the last
vacancy, concurring that the one-on-one interviews were
advertised as a public meeting, and the public was welcome to sit
in at any or all of the individual interviews.

Mayor Klausing opined that it was the consensus of each
Councilmember to have an open process and abide by the spirit
and letter of the law.

City Attorney Anderson was directed to review recent case law to
determine the Open Meeting law and serial interview processes,
and advise the City Council of his legal opinion on the
appropriateness of individual interviews.
