City Manager Malinen said he provided a complaint <br />form to use if he chose, in accordance with the City's normal proccdure. <br />Chair Delmore suggested that she contact the complainant to advise him of tonight's discussion, <br />as well as the existence of lhe surveillance tape. <br />Commissioner Singleton noted that with a complaint process in place, it appeared that ihe <br />complainant was seeking to go around that normai process. <br />14 Commissioner McKenzie said based on her past experience on the HRC in addition to her work <br />15 in the legal field, she preferred to follow the process and recommended that the complainant filc <br />16 a complaint and submit that prior to further HRC iz�volvement or discussion. <br />17 <br />1$ City Manager Malinen questioned whether the �IRC was the proper forum for thc complainant, <br />19 given that a grievance process is in place. City Manager Malinen assured Commissioners the <br />20 Police Chief, the Police Department and he took formal complaints seriously. Malinen said he <br />21 was unsurc why thc complainant was rcluctant to file a writtcn complaint if he was not satisfied <br />22 with discussions. <br />23 <br />24 Commissioner McGehee suggested ihat Chair Delmore contact the complainant to advise him of <br />25 tonight's HRC discussion, and to encourage him to fill out a formal complaint form, and in <br />26 addition, to provide the IIRC — in writing — his point of view and review of ihe situation, and his <br />27 preferred outcome of this situation. Commissioner McGehee opined that the complainant didn't <br />28 have to attend an HRC meeting; but suggestcd that Chair Dclmorc could request the video tape <br />29 for the HRC to rcview at an upcoming meeting. <br />3a <br />31 Commissioner McGehee opined ihat it was recourse if people didn't trust the process. <br />32 <br />33 City Manager Malinen opined that, while a complaint process was already in place, the HRC was <br />34 promoting that one individual who may not like that process, a complainant could circum.vent the <br />35 process, serving to undermine the Police Department and a proccss by which citizeas would get <br />36 problems addressed. <br />37 <br />38 Chair Delmore took issue with City Manager Malinen's interpretation of the number of citizen <br />39 complaint:s being heard. <br />40 <br />41 Commissioner Crump opined that he would prefer to see a written complaint; and if he has an <br />42 issue, the complainant follow the process by submitting the complaint to the Police Chief, vtrith a <br />43 copy to City Manager Malinen, and possibly the HRC. Commissioner Crump expressed concern <br />44 that, if there was a danger of potential litigation, thc HRC ncedcd to remain moot until that <br />45 litigation was resolve. <br />46 <br />
