Mr. Paschke reiterated staffs rationale, as supported by the City Attorney, that staff followed zoning code, and didn't' anticipate long-range plans as outlined in the City's Comprehensive Plan, a guide for future development, but not legislated code. Mr. Paschke opined that the previous Community Development Director, legal counsel, and staff had interpreted existing code and indicated that an Interim Use Permit was not appropriate, but that the Conditional Use Permit was appropriate to support the existing use. Public Comments No one appeared for or against. Mr. Dave Ort, the applicant, was present to represent Cummings Mobility. Councilmember Ihlan questioned Mr. Ort as to whether an Interim Use Permit would suffice, rather than a Conditional Use Permit, and allow the same activities on the site. Mr. Ort declined to make a determination, without investigating long-term ramifications and implications on the site. Councilmember Kough had several questions, addressed by Mr. Ort, as to the nature of the business, and ownership of the property. Klausing moved, Kough seconded, adoption of Resolution No. 10460 entitled, "A Resolution Approving a Conditional Use Permit in Accordance with 91005.015 and 91013.01 of the Roseville City Code for Cummings Mobility, 1755 County Road C (PF 3767)." Mayor Klausing, while recogmzmg Councilmember Ihlan's concerns, opined that by inaction, the City could make the situation worse by preventing current property owners from reasonable and continued use of the property and keeping it from further deterioration.
