<br />City Council Regular Meeting - 12/18/06 <br />Minutes - Page 22 <br /> <br />based on potential future zoning designation of the lot, and her <br />interpretation that staff was recommending approval of a CUP in <br />conflict with the City's Comprehensive Plan. <br /> <br />Mr. Paschke reiterated staffs rationale, as supported by the City <br />Attorney, that staff followed zoning code, and didn't' anticipate <br />long-range plans as outlined in the City's Comprehensive Plan, a <br />guide for future development, but not legislated code. Mr. <br />Paschke opined that the previous Community Development <br />Director, legal counsel, and staff had interpreted existing code and <br />indicated that an Interim Use Permit was not appropriate, but that <br />the Conditional Use Permit was appropriate to support the <br />existing use. <br /> <br />Public Comments <br />No one appeared for or against. <br /> <br />Mr. Dave Ort, the applicant, was present to represent Cummings <br />Mobility. <br /> <br />Councilmember Ihlan questioned Mr. Ort as to whether an Interim <br />Use Permit would suffice, rather than a Conditional Use Permit, <br />and allow the same activities on the site. <br /> <br />Mr. Ort declined to make a determination, without investigating <br />long-term ramifications and implications on the site. <br /> <br />Councilmember Kough had several questions, addressed by Mr. <br />Ort, as to the nature of the business, and ownership of the <br />property. <br /> <br />Klausing moved, Kough seconded, adoption of Resolution No. <br />10460 entitled, "A Resolution Approving a Conditional Use <br />Permit in Accordance with 91005.015 and 91013.01 of the <br />Roseville City Code for Cummings Mobility, 1755 County Road <br />C (PF 3767)." <br /> <br />Mayor Klausing, while recogmzmg Councilmember Ihlan's <br />concerns, opined that by inaction, the City could make the <br />situation worse by preventing current property owners from <br />reasonable and continued use of the property and keeping it from <br />further deterioration. <br />
