<br />Roseville City Council <br />Minutes of 1/29/07 Pg 9 of 38 <br />Mayor Klausing further opined that there would only be additional <br />time and expense if another law firm was brought in at this time. <br /> <br />Councilmember Pust, speaking from her expertise as a litigation attor- <br />ney, opined that the expertise of the Iverson Reuvers law firm had al- <br />ready been developed in this fact-specific conflict, and that if another <br />firm were hired at this time, it would negate that expertise already de- <br />veloped, and create the need to relearn facts already in evidence, and <br />as argued over the last two years. <br /> <br />Councilmember Ihlan advised that those lawyers involved to-date had <br />a stake in the development and previous litigations, with Krass Mon- <br />roe drafting the original contract now under dispute; with Iverson <br />Reuvers serving as co-counsel with the developer in the citizen law- <br />suit; and reiterated her support for new independent counsel to pro- <br />vide taxpayers with the best results; opining that the law finns used <br />to-date had all given the City advise that had landed the City in court. <br /> <br />Roll Call <br /> <br />Ayes: Kough and Ihlan <br />Nays: Roe; Pust and Klausing. <br />Motion failed. <br /> <br />Pust moved, Roe seconded, approval of the selection ofIverson Reu- <br />vers law firm to continue representing the City on Twin Lakes litiga- <br />tion matters. <br /> <br />Roll Call <br />Ayes: Roe; Pust; and Klausing. <br />Nays: Kough and Ihlan. <br />Motion carried. <br /> <br />4. Consider Items Removed from the Consent Agenda. <br /> <br />4.a Reimbursable Twin Lakes Expenses <br />City Manager Malinen provided a brief review of the Twin Lakes Re- <br />development Project. <br /> <br />City Attorney and Mayor Klausing confirmed that these expenses <br />were reimbursable, pursuant to the redevelopment agreement, or <br />through proceeds from the developer's Letter of Credit. <br />
