<br />Regular City Council Meeting <br />Monday, June 11,2007 <br />Page 23 <br /> <br />Mr. Stark advised that staff had continued to meet with HRA repre- <br />sentatives, Westwood Village Association directors, and private fi- <br />nancIers. <br /> <br />City Attorney Scott Anderson provided an opinion on the pending six <br />month time frame for enactment of an ordinance establishing the area <br />from the date of concluding the hearing. Mr. Anderson addressed the <br />interpretation of the December 28, 2006 Council meeting when the <br />initial Public Hearing had been held, with staff noting that the Hearing <br />had been closed at that time, not continued. Mr. Anderson provided <br />several options for the City Council to consider as their next action, <br />including: <br />1) Set up another Public Hearing upon receipt of all material needing <br />to be gathered and presented, then take public comment; <br />2) Deny establishment at this time, on the finding that sufficient ma- <br />terials have not been presented, and ask the petitioners to reapply. <br />Mr. Anderson opined that the Statute was silent on the City Council <br />extending the request. <br /> <br />Councilmember Pust, speaking on behalf of the HRA, expressed on- <br />going interest in pursuing establishment of an RIA; however, noted <br />that additional information as outlined in the staff report dated June <br />11, 2007, remained pending. Councilmember Pust recommended es- <br />tablishing another Public Hearing and leaving it open-ended. <br /> <br />Councilmember Roe suggested a third option, to re-open the Public <br />Hearing tonight, and keep it open until such time as sufficient infor- <br />mation became available. <br /> <br />City Attorney Anderson concurred that this would be another option. <br /> <br />Mayor Klausing expressed interest in Councilmember Roe's sugges- <br />tion. <br /> <br />Sue Shay, President, Westwood Village I Homeowner's Associa- <br />tion <br />Ms. Shay advised that the Association would agree to re-opining the <br />Public Hearing, since 80% of the residents had signed the petition, <br />
