Regular City Council Meeting AND <br /> Board of Adjustments and Appeals <br /> Monday,July 16,2012 <br /> Page 18 <br /> Councilmember Johnson noted that, since only one applicant was heard at this <br /> time, he personally didn't want to limit licensing hours to that establishment, <br /> and suggesting broadening the time from 11:00 a.m. to 11:00 p.m., with the un- <br /> derstanding that the earlier start may not be a preference on a weekday, but <br /> could be more beneficial on the weekend and prevented the applicant from hav- <br /> ing to return to the City Council for a request for revised hours. <br /> Mayor Roe noted that staff's suggestion was to reference hours for these estab- <br /> lishments consistent with that of State Statute for off-sale establishments. <br /> Finance Director Miller clarified that staff's recommendation was prior to hear- <br /> ing from the applicant about Sundays as well. <br /> Councilmember McGehee opined that she had no problem with the hours; how- <br /> ever, in her review of the applicant's materials, she found few business models <br /> open until 11:00 p.m., and personally preferred 10:00 p.m. closing. Coun- <br /> cilmember McGehee noted that this seemed a more common time in the materi- <br /> als supplied, and yet shouldn't provide any hardship for the applicant. Coun- <br /> cilmember McGehee opined that she preferred hours of operation 10:00 a.m. to <br /> 10:00 p.m. <br /> After further thought, Councilmember Johnson questioned if a licensee could <br /> even sell a growler after 10:00 p.m., and reverted to closing time of 10:00 p.m. <br /> instead of his original suggestion of 11:00 p.m. <br /> Relative to on-sale, Mr. Miller noted that this allowed some differentiation. <br /> Mayor Roe, in his review of sample establishments provided by the applicant, <br /> noted that nine (9) establishments were open until 11:00 p.m. or later at least <br /> some night of each week. Mayor Roe noted that he didn't see any starting earli- <br /> er, but for consistency and comparison purposes, noted that on-sale establish- <br /> ments with restaurants could begin selling alcohol as early as 8:00 a.m. <br /> Regarding the off-sale component, Councilmember Johnson advised that he was <br /> more supportive of the 10:00 a.m. to 10:00 p.m. range, since it would be easier <br /> for the City's Police Department to monitor and enforce, avoiding any potential <br /> that they could or could not continue selling growlers between 10:00 — 11:00 <br /> p.m. Councilmember Johnson suggested that the 10:00 p.m. cut-off seemed <br /> more concise. <br /> Mr. Denglin advised that an establishment, per State Statute, had to personally <br /> ensure that any person having a growler was to be off-site by 10:00 p.m. <br /> Mayor Roe observed that this would help to maintain enforcement of that issue. <br />
