Regular City Council Meeting AND <br /> Board of Adjustments and Appeals <br /> Monday,July 23,2012 <br /> Page 21 <br /> Mayor Roe noted that there were options beyond electronic methods to sign up <br /> for Parks and Recreation classes and programs; however, in Data Privacy Act <br /> presentations given during Roseville University sessions, it was his understand- <br /> ing that once provided, that information also became public data. <br /> Mayor Roe noted that there were many ways information became public; how- <br /> ever, he emphasized that the City did not actively sell data on its own; however, <br /> once a request is made and fulfilled as required by law, the information is out <br /> there. <br /> City Manager Malinen apologized to the public and the City Council for the <br /> angst caused by this situation and release of e-mail addresses; however, he stat- <br /> ed that staff believed it was complying with the requirements of the Data Priva- <br /> cy Act, and while the timing may have been problematic in alerting those partic- <br /> ipants of the situation, the results wouldn't have changed. City Manager Ma- <br /> linen advised that staff felt bad about the situation as well. <br /> At the request of Mayor Roe, City Attorney Gaughan clarified that once an e- <br /> mail address has been provided and becomes public data, it doesn't matter if <br /> they unsubscribe or not, the information is in the public realm. <br /> Mayor Roe noted that this had been a very difficult and unpleasant learning ex- <br /> perience for everyone involved. <br /> 11. Public Hearings <br /> a. Request for a 3.2% On-Sale, Sunday Liquor and Wine License for Kyoto <br /> Sushi at 2100 N Snelling Avenue, Suite 80 <br /> Finance Director Chris Miller briefly reviewed this request for a 3.2% On-Sale <br /> Sunday Liquor and Wine License for Kyoto Sushi at 2100 N Snelling Avenue, <br /> Suite 80 (former location of Buffalo Wild Wings), as detailed in the Request for <br /> Council Action (RCA) dated July 23, 2012. Mr. Miller advised that staff rec- <br /> ommends approval based on their analysis of the application. <br /> The applicant was not present at tonight's meeting. <br /> Mayor Roe opened and closed the Public Hearing at approximately 7:59 p.m., <br /> with no one appearing for or against. <br /> 12. Business Items (Action Items) <br /> a. Consider a 3.2% On-Sale Sunday Liquor and Wine License for Kyoto Su- <br /> shi at 2011 N Snelling Avenue, Suite 80 <br />
