, ., <br />CITY POLICY <br />TITLE_ Newspaper Z7ending Machines in Boulevards <br />4/23/s2 <br />Backqround Sta�ement: The current City Code speci�ies �hai newsstands <br />are a use ihat is permit�ed in the boulevard areas. Na newsstands <br />in the old-time, traditional sense have been constructed in Roseville; <br />however, recently, several newspap�r vending rnachines have been <br />piaced on the boulevards. The Code carries no provis�.ons or criteria <br />relating to how or when �hese machines are to be installed. No <br />request for, nar issuance of, any right-of-way permit by either the <br />City or Ramsey County has ever occurred. <br />In order to provide adequate protection to insure both high aesthetic <br />quality in the conununity and a safe transportation system, a more <br />contralled method needs to be established for dea].ing with the situation. <br />Folicy Statement: The availabiiity o� a£ree and op�n press to provide <br />information to the citizenry is valuable to the coinmunity, and is to be <br />encouraged. The ex�ent af this availabili�y, however, has to be <br />balanced against other iinportant needs of �he community. The aspect of <br />this situa�ion as it rela�es �o having newspaper vending machines placed <br />on the baulevards of public rights-of-way is a situation where special <br />efforts are required to safeguard aZl the interests involved_ Overal.l <br />con-�munity values and aesthetic features as well as public safety must <br />be taken into accounf in the decision-making process fox contr�lling <br />the placemen� of the newspaper vending machines in boulevards. <br />f Procedure Statement: Anyone wishing to place a newspaper vending <br />machine in the boulevard of any public roadway in the City of Roseville <br />may do so only after compl.ying with the following requirements: <br />1. Obtain a right-of--way permit from the Roseville Public G�7orks <br />Department for each machine, regardle5s o� the street jurisdiction <br />involved. A R�seville Pubiic Vdorks permit would be granted only <br />when the following conditions are met: <br />(a) The machi.ne owner shall agree to remove it at no cost to <br />the city, if the city determines it to be necessary for public <br />improvements or maintenance activity; or if it is determined <br />by the city that a safety hazard exists due to its location. <br />{b} The machine shall not be attached to any public facility <br />such as a utility pole, roadway sign or firehydrant. <br />(c) The machine shall be o� a single color, except for <br />lettering which sha�l not exceed 4" in height. Said <br />lettering shal� be �o identify the newspaper only, and <br />sha11 not be an adverti.sing device. <br />(d) The maximum size o� the machine sha11 be 4' high, 2' wide, <br />and 2' Iong. The exception woul.d be tha� in ttiat area within <br />4�' of the corner right-of-way as m�asured along the pxoperty <br />line, that the maximum height shall not exceed 30". <br />(e) The machine shall be placed in the right-of-way, in the <br />manner which results in no portion o� it being within 4' of <br />the nearest edge of pavement or face of curb of the adjacent <br />roadway. <br />(f) No more than one machine per publisher shall be allowed <br />within 1,000' of any other newspaper vending machin� of tnat <br />same newspaper publisher. <br />(g) t10 machine shall be allowed where R-2oned property is <br />directly adjacent to the b�ulevard where the machine is to <br />be located. <br />
