Appeal of Network Trips: In the event that the property owner(s) of a Block do not agree 170 <br />with the determination of the Network Trips a llocated to their Block pursuant to Section 171 <br />E above, the property owner(s) of such Bloc k may appeal the determination to the 172 <br />Roseville City Council. No appeal may be taken with respect to the Network Trips 173 <br />allocated in Section E above unless the aff ected property owner(s) file a written appeal 174 <br />with the City Manager within one hundred eigh ty (180) days after the adoption of this 175 <br />ordinance. The failure to file a timely appeal eliminates all right to challenge a Network 176 <br />Trip allocation designated in Section E a bove. The appeal must be accompanied by a 177 <br />report prepared by a registered traffic e ngineer which provides evidence indicating 178 <br />potential errors in the determination of the Network Trips and the reasons why the 179 <br />determination of Network Trips is not accurate. When an appeal is filed the matter shall 180 <br />be heard and considered by the Roseville City Council at a p ublic meeting. The property 181 <br />owner(s) making the appeal shall be given th e opportunity at the meeting to testify and 182 <br />present evidence with respect to the Network Trips allocated to their Block. Notice of the 183 <br />meeting shall be mailed to the appealing prop erty owner(s) at the address where the tax 184 <br />statement for the Block which is subject to the appeal is mailed according to the records 185 <br />of the Ramsey County Property Tax Depart ment. Following making its decision, the 186 <br />City Council shall serve a copy of its decisi on upon the property ow ner(s) of the Block 187 <br />which was the subject of the appeal by mail at the address where tax statements for such 188 <br />Block is mailed. No judicial action shal l be taken regarding the determination of 189 <br />Network Trips allocated to a Block pursuan t to Section E above unless and until the 190 <br />foregoing appeal is made to the City C ouncil and the City Council has rendered and 191 <br />served its decision on the matter. 192 <br /> 193 <br />G. Other Improvements: Nothing in the Sectio n may be construed to eliminate property 194 <br />owner(s) responsibility for other improvements unrelated to the Roadway Infrastructure 195 <br />Improvements. If a traffic study finds that road system improvements unrelated to the 196 <br />Roadway Infrastructure Improvements are required as a result of the proposed 197 <br />development, the development may not be commenced until arrangements, including 198
