Regular City Council Meeting <br /> Monday, October 22, 2012 <br /> Page 16 <br /> Lt. Rosand provided specific information regarding the compliance failure on <br /> August 31, 2012, of the Rainbow Foods Liquor Store, located at 1201 Larpen- <br /> teur Avenue; and subsequent findings specific to that compliance failure as out- <br /> lined in the RCA. <br /> Lt. Rosand recommended that the Police Department be authorized to issue and <br /> administer the presumptive penalty as set forth in Section 302.15 of Roseville C <br /> city Code, and also consider further penalty of an additional presumptive penal- <br /> ty for failing to provide current Manager and Server training. Lt. Rosand used <br /> the previous City Council action for the Smash Burger Restaurant as an exam- <br /> ple of a situation and additional fine applied for a similar infraction. <br /> Discussion included how frequently the online training was updated by the De- <br /> partment for use by license holders; pending work by the Department to accept <br /> Sure Sell as an authorized training provider for license holders; and Lt. <br /> Rosand's clarification that the Sure Sell website clearly identified the City of <br /> Plymouth, not the City of Roseville, as currently having an agreement for train- <br /> ing, and recognizing that both municipalities may have different ordinances that <br /> applied to alcohol licensing within their jurisdictions. <br /> Lt. Rosand reviewed the specific status of the nine (9) training certificates held <br /> by Rainbow employees at this site, with two (2) current from Sure Sell, three(3) <br /> having been found to be expired beyond the one (1) year training requirements <br /> of Roseville, and three (3) completed post-violation (Attachment A to the Police <br /> Report. <br /> Lt. Rosand advised that he had spoken earlier today to the Rainbow Manager, <br /> Susan Quinn, who was ill and unable to attend tonight's meeting; and read for <br /> the record her written comments that she had provided to him in lieu of her at- <br /> tendance, and intent for future training. <br /> Pust moved, McGehee seconded, authorizing the Police Department to issue <br /> and administer the presumptive penalty to Rainbow Foods Liquor Store at 1201 <br /> Larpenteur Avenue, of a $1,000 fine and zero (0) day suspension for sale of al- <br /> cohol to an underage person. <br /> Roll Call <br /> Ayes: Willmus; Johnson; Pust; McGehee; and Roe. <br /> Nays: None. <br /> Pust moved, Willmus seconded, authorizing the Police Department to impose an <br /> additional $1,000 fine to Rainbow Foods Liquor Store for failure to comply <br /> with manager/server training requirements as applicable. <br /> Councilmember Johnson advised that is he had observed from Rainbow's em- <br /> ployee roster that they had attempted training compliance he may have spoken <br /> to granting more leniencies.
