Attachment A CK�7� 7 �111I\1/1 �1►` 1171 1 �I�f�[��I THIS CONTRACT AMENDMENT NO. 1 is made by and between the CITY OF ROSEVILLE, 2660 Civic Center Drive, Roseville, Minnesota 55113 ("Owner"), and BOSSARDT CORPORATION, 5270 West 84th Street, Suite 550 Minneapolis, Minnesota 55437 ("Construction Manager"). WHEREAS, the Owner and Construction Manager have entered into a contract dated January 2, 2012, to provide Construction Management Services in connection with the construction of the City of Roseville New Fire Station Project located at 2701 Lexington Avenue, Roseville, Minnesota ("Original Contract"); and WHEREAS, it has become necessary for the Construction Manager to perform additional construction services in connection with the Project; and WHEREAS, the parties desire to amend the Original Contract to provide for the performance of, and payment for, such additional construction services; NOW THEREFORE, the parties mutually agree to amend the Original Contract as follows: L The Construction Manager hereby agrees to perform Construction Phase Services through September 30, 2013. 2. In consideration for the performance of such Construction Phase Services through September 30, 2013, the parties agree that the total Construction Manager's Basic Services Fee shall be $258,300.00, instead of $184,500.00. The additional Construction Manager's Basic Services Fee of $73,800.00 shall be paid in six (6) equal monthly installments of $12,300.00 payable on May 1, 2013, June 1, 2013, July 1, 2013, August l, 2013, September 1, 2013 and October l, 2013. 3. The date of commencement of construction is hereby revised to be August 21, 2012 and the substantial completion date is hereby revised to be September 30, 2013. It is anticipated that the Owner shall occupy the Project on or before October 1, 2013. 4. The Owner's budget for the total project is hereby amended to be $9,013,908.00. 5. The parties acknowledge and agree that the compensation set forth in the Original Contract and this Contract Amendment No. 1 is intended to fully compensate the Construction Manager for all of the Construction Manager's Basic Services to be performed by the Construction Manager through September 30, 2013. The Owner shall not be required to pay any additional compensation (other than the compensation set forth in the Original Contract and this Contract Amendment No. 1) pursuant to Section 4.3 of the Original Contract as a result of the amendments made herein, unless the parties hereinafter otherwise agree in writing. 1
