Regular City Council Meeting <br /> Monday, February 25,2013 <br /> Page 16 <br /> City Engineer Debra Bloom summarized the request by petition for public im- <br /> provements, as detailed in the RCA dated February 25, 2013. <br /> At the request of Mayor Roe, Ms. Bloom identified and clarified specific utilities <br /> proposed on the site plan. <br /> Ms. Bloom reviewed the project estimate, with 100% of the costs borne by the <br /> property owner/petitioner; and upon advice of the City Attorney, Ms. Bloom ad- <br /> vised that the City would request a waiver from the petitioner to any future rights <br /> of appeal. Ms. Bloom advised there would be no assessment hearing,but that on- <br /> ly the actual cost of construction would be assessed versus the engineer's esti- <br /> mate; and proposals would be solicited versus public bid over the next few <br /> months. <br /> Ms. Bloom reviewed the projected work schedule, with final plans completed in <br /> March, proposals solicited in April and May, and a construction start proposed in <br /> June with completion in July of 2013. Ms. Bloom advised that staff would return <br /> to the City Council with an agreement with the property owner, and seeking con- <br /> tract award. Ms. Bloom anticipated that the entire project would be completed <br /> within a 2-3 week timeframe. <br /> At the request of Councilmember McGehee, Ms. Bloom addressed City Code re- <br /> garding protection of mature trees; however, she noted that a twenty-foot wide <br /> swath would be required for a utility trench,with utilities 10-15 feet deep. <br /> At the request of Mayor Roe, City Attorney Gaughan advised that the proposed <br /> process was appropriate from a Chapter 429 assessment process, based on a re- <br /> quest for proposals applicable due to a total project cost less than $100,000.00; al- <br /> lowing the City to seek a minimum of two (2) quotes versus a more formal bid <br /> process, in accordance with state statute. <br /> Mayor Roe opened and closed the Public Hearing at approximately 8:43 p.m., <br /> with no one appearing for or against. <br /> McGehee moved, Etten seconded, adoption of Resolution No. 11054 entitled, <br /> "Resolution Ordering the Improvement and Preparation of Plans and Specifica- <br /> tions for Utility Construction at 3040 Hamline Avenue." <br /> Roll Call <br /> Ayes: Laliberte; McGehee; Etten; and Roe. <br /> Nays: None. <br /> Councilmember Willmus returned to dais at this time. <br /> 12.
