• <br />�_� <br />CITY OF ROSEVILLE <br />PLANNED UNIT DEVELOPMENT AGREEMENT #13%S <br />APPROVED SEPTEMBER 15, 2OOH <br />AMENDED AUGUST 24, 2009 (PFO7-OO6) <br />This PLANNED LTNIT DEVELOPMENT AGREEMENT ("AGREEMENT"), dated September <br />15, 2008 and amended on August 17, 2009 is entered into between the City of Roseville, a <br />Minnesota municipal corporation, of 2660 Civic Center Drive, Roseville, Minnesota 55113 <br />(herein referred to as "CITY") and United Properties, 3500 American Boulevard West, Suite <br />200, Bloomington, MN 55431 (herein referred to as "DEVELOPER"). <br />1. EFFECTIVE DATE OF AGREEMENT <br />This AGREEMENT shall be effective upon completion of the following: 1) Passage of <br />Applewood Pointe of Langton Lake, the required subdivision plat for the property, and <br />submission of the same for recording with the Ramsey County Recorder; 2) Passage and <br />publication of Ordinance #1375 rezoning the property from Single Family Residence (R- <br />1) District to Planned Unit Development (PUD) with an underlying zoning of General <br />Residence (R-3) District; 3) submission of all revised plans identified as Exhibits in <br />Section 4 of this AGREEMENT; 4) execution of this AGREEMENT by the CITY and <br />the DEVELOPER; and 5) submission of this AGREEMENT for recording with the <br />Ramsey County Recorder. <br />2. REQUEST FOR PLANNED UNIT DEVELOPMENT APPROVAL <br />The DEVELOPER has requested that the CITY approve an 6.5 acre redevelopment <br />consistent with the Roseville Comprehensive Land Use Plan and the Twin Lakes Master <br />Plan into a Planned Unit Development (PUD) that includes a 4-story, age-restricted <br />senior cooperative of up to 95 residential units developed in two phases: Phase I <br />comprising approximately half of the 95 units, and a possible Phase II with a maximum <br />full build-out of the remainder of the approved 95 units. Upon recording of the plat, the <br />Subject Property is legally described as: <br />Lot 1 and Lot 2, Block 1, Outlot A, and public right-of-way <br />dedicated to the City of Roseville, Applewood Pointe of Langton Lake <br />3. PLANNED UNIT DEVELOPMENT APPROVAL <br />The CITY hereby grants approval of the amended Planned Unit Development (identified <br />as Exhibits A through I in Section 4.0 of this AGREEMENT), subject to the <br />DEVELOPER'S compliance with the terms and conditions of this AGREEMENT and <br />any and all applicable requirements of Title 10 of the Roseville City Code, unless <br />otherwise identified herein. The CITY agrees to approve applications for building <br />permits, if said applications meet all of the requirements for issuance of building permits <br />and are consistent with the plans identified in Section 4.0 below. For any improvements <br />not contemplated in this AGREEMENT, the CITY may require compliance with any <br />amendments to the Comprehensive Guide Plan, official controls, platting, or dedication <br />requirements enacted after the date of this AGREEMENT. <br />
