• • <br />August 27, 2oos U N I T E D P R O P E R T I E S <br />Pat Trudgeon <br />Community Development Director <br />City of Roseville <br />2660 Civic Center Drive <br />Roseville, MN 55113 <br />RE: Applewood Pointe Cooperative Extension <br />Dear Pat: <br />Per a letter from the City dated July 7, 2008 the review deadline pursuant to State <br />Statute 15.99 was extended an additional 60 days from July 8, 2008. During the City <br />Council meeting last Monday, August 25'", it was determined that there is an issue <br />pertaining to the preliminary plat. Apparently, the time limit from the date of the initial <br />submission of the preliminary plat expired, resulting in the necessity for further review by <br />the City Attorney. As a result, the earliest the City Council could take up this issue would <br />be at their next City Council meeting on September 8th — two days after the expiration of <br />the current review deadline. <br />In an effort to assist in providing adequate time for the City and Staff to resolve this plat <br />issue, and as indicated in our discussions last Monday, United Properties is wiliing to <br />waive its rights under Statute 15.99 indicating "failure of an agency to deny a request <br />within 60 days is approval of the requesY', as it relates to the expiration of the current 60- <br />day review deadline expiring September 6, 2008. In other words, in exchange for the <br />City Council's willingness not to deny the project while seeking time to resolve the plat <br />issue, we recognize that the plat approval request is not automaticaliy approved. We <br />are also seeking an extension pursuant to Statute 15.99 subpart 3(g) of an additional <br />review period from September 6, 2008 to November 10, 2008.
