.� <br />--• <br />Attachment E <br />�� � CITY of ROSEVILLE <br />� PLANNED UNIT DEVELOPMENT AGREEMENT #1225 <br />3 AGREEMENT, approved by the Roseville City Council on July 12, 1999, and entered into between <br />4 the City of Roseville, a Minnesota municipal corporation (herein referred to as "CITY"), and L.J. <br />5 Olson Heritage, LLC, 1940-1944 Lexington Avenue North, Roseville, Minnesota, 55113 (herein <br />, referred to as "DEVELOPER"). <br />� AGREEMENT A1�1E1�D1�1ENT, affecting Section 9 herein, approved by the Roseville City <br />r Council on September 24, 2007, and continued between the City of Roseville, a Minnesota <br />� municipal corporation (herein referred to as "CITY"), and G& K Properties, 7195 137`� Street <br />�o North, Hugo, Minnesota _55038 (hereinafter assuming the title of "DEVELOPER"). <br />� � 1.0 Effective Date of Agreement <br />i2 This agreement shall be effective upon completion of the following: 1) passage and publication of <br />13 Ordinance # 1225 (Rezoning of Property to PUD); 2) publication of the ordinance in the CITY's <br />14 official newspaper; 3) execution of this agreement by the CITY and the DEVELOPER; and 4) <br />15 recording of this agreement with Ramsey County. <br />i � 2.0 Request for Planned Unit Development Approval <br />17 The DEVELOPER has asked the CITY to approve a multi-tenant Planned Unit Development (PUD) <br />18 (PF#3077) that provides renovation and additions totaling 4,516 square feet for the office, retail and <br />� 9 laboratory facility. The property is legally described as follows: <br />20 1940 Lexington Avenue North (PID # 142923230067) Ciry of Roseville, Ramsey Counry, <br />21 Minnesota, legally described as follows: <br />22 Section 14, Township 29, Range 23, except the South 183 feet of the West 183 feet of <br />23 the South %z of the Southwest'/ of the Southwest'/ of the Northwest'/ (subject to <br />24 highway) Section 14, Township 29, Range 23, Ramsey County, Minnesota. <br />25 3.0 Planned Unit Development Approval <br />�6 The CITY hereby grants approval of the final development plan for the DEVELOPER, subject to the <br />27 compliance with the terms and conditions of this agreement. The CITY agrees to approve <br />28 applications for building permits provided; the plans are consistent with the exhibits approved at the <br />29 concept and final stages of the Planned Unit Development process; the DEVELOPER has not <br />30 defaulted; and all of the standards and conditions of this agreement have been satisfied. <br />3� For three years from the date of this Agreement, no amendments to the CITY'S Comprehensive <br />32 Guide Plan or official controls shall apply to or affect the use, development density, site layout, or <br />33 dedication requirements of the land included in the Planned Unit Development, unless required by <br />3� state or federal law or agreed to in writing by the CITY and the DEVELOPER.
