� <br />5.0 Rezoning <br />^ <br />L The CITY conducted hearings and meetings on March 10 & April, 1999 (Planning Commission - <br />? hearing on concept development plan), April 26, & May 10,1999 (City Council — action on concept), <br />�+ June 23 & July 12, 1999 (City Council — hearing and action on final development plan and action on <br />5 PUD agreement) to consider various aspects of the Planned Unit Development, including rezoning <br />6 of the subject property from B-1, Limited Business District to Business-Planned Unit Development <br />7 (B-PUD). The CITY agrees to rezone the subject property to Business-Planned Unit Development <br />� (B-PUD), subject to the DEVELOPER'S strict compliance with the approved plans, and the terms <br />� and conditions of this agreement. Minor variations from the approved final development plans, <br />1 � which are consistent with this agreement and the underlying B-1 zoning district, may be approved by <br />1 � the CITY's Development Review Committee, under the direction of the Community Development <br />12 Director. Substantial departures from the approved final development plans will require an <br />� 3 amendment to the Planned Unit Development in accordance with Section 1015 of the Roseville <br />1�? Zoning Ordinance. Where not superseded by more restrictive requirements of this PUD, the <br />15 standards of the underlying B-1 (Limited Business) zoning district shall apply, as stated in Chapter <br />� 6 1005 of the Roseville City Code. <br />" r 6.0 Development of Property <br />�� Failure by the DEVELOPER to commence development activity in accordance with the final <br />19 development plans or within one year following the final approval of this Planned Unit <br />2C Development, will necessitate the approval of an extension of the development schedule by the City <br />2 � Council prior to the expiration of the one year period. If an extension is not applied for, the Council <br />22 may instruct the Planning Commission to initiate rezoning to the original B-1 zoning district. For <br />23 purposes of this provision, development activity shall be defined as obtaining a building permit and <br />24 beginning construction on the site. <br />2� Development of the property and installation of improvements shall be in accordance with the <br />�6 development schedule provided by the DEVELOPER and approved by the CITY (Exhibit F). <br />27 7.0 Compliance with Laws and Regulations <br />28 The DEVELOPER represents to the CITY that any site improvements pursuant to the proposed <br />29 Development will comply with all City, County, Regional, Metropolitan, State, and Federal laws and <br />�0 regulations, including but not limited to the Roseville Subdivision Regulations, the Roseville Zoning <br />3 � 8.0 Site Development Requirements <br />32 To insure that the proposed development meets the CITY'S requirements and standards for site <br />33 development, the following provisions shall apply: <br />34 8.1 Final Grading Plan. The final grading plan for the property must be reviewed and approved <br />�5 by the Director of Public Works prior to any permits being issued for the building addition. <br />36 All grading shall comply with the approved grading plans and shall be the responsibility of <br />37 the DEVELOPER. The DEVELOPER'S engineer shall provide to the CITY a letter <br />3� certifying that the grading project as constructed, was completed as depicted in the approved <br />39 grading plan (Exhibit D). <br />Page 3 of 11 <br />
