''\ � EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 18t" day of June 2007, at 6:00 p.m. The following members were present: and the following were absent: Council Member introduced the following resolution and moved its adoption: RESOLUTION NO. A RESOLUTION APPROVING A CONDITIONAL USE PERMIT IN ACCORDANCE WITH §1005.015 AND §1013.01 OF THE ROSEVILLE CITY CODE FOR ROSEDALE COMMONS LP AND PETSMART, 2480 FAIRVIEW AVENUE (PF07-026). WHEREAS, PetSmart (in cooperation with Rosedale Commons LP, property owner) has requested a CONDITIONAL USE PERMIT to allow a pet and pet supply store within Rosedale Commons shopping center; and WHEREAS, the use, pet and pet supply store, required a CONDITIONAL USE PERMIT in § 1013.01 of the Roseville City Code; and WHEREAS, the subject property is located at 1800 Highway 36 Frontage Road and legally described as: REQUIRE LEGAL DESCRIPTION WHEREAS, Section 1013 establishes the criteria for reviewing conditional use permits, which is as follows: a. Impact on traffic b. Impacts on parks, streets and other public facilities c. Compatibiliry of the site plan, internal circulation, landscaping and structure with contiguous properties d. Impact of the use on market value of contiguous properties e. Impact on the general public health, safety and welfare f. Compatibiliry with the City's Comprehensive Plan WHEREAS, The Roseville Planning Commission held the public hearing regarding the PetSmart request on June 6, 2007, recommending (6-0) approval of the CONDITIONAL USE PERMIT, subject to conditions;
