� <br />-. <br />regarding height, setbacks and parking. <br />Question two answer: Art Mueller was not involved in the original proposal for the site, <br />but did develop Midland Grove Condos. <br />Question three answer: Prior to August 2003 the Code read -"No structure or building <br />shall exceed 3-stories or 30 feet, whichever is less. On August 7, 2003 the residential <br />section of che Code was amended to the current - a chart that states 30 feet, unless allowed <br />higher by a conditional use. However, the R-3 and R-3A districts state a maximum height <br />of 3-stories. The issue of height has not been as controversial with past projects requiring <br />the Planning Staff to determine the Code to be "in conflict with itself." <br />Assuming that the City Council supports the Comp Plan map amendment, rezoning and <br />General Concept pian, there would be no need for a condition to protect the City. The <br />project would be tied to the PUD agreement and if this specific project - The Orchard - <br />never came to fruition, it could not be developed any other way except as approved. Any <br />proiect proposed thereafter would require a land use action in order to be allowed. These <br />actions could include Comp Plan amendment, zoning or another PUD.
