shall be reduced to writing in the form of an amendment to the <br />contract. <br /> 8.05. Liquidated Damages <br />The Contractor shall agree, in addition to any other remedies <br />available to the City, that the City may withhold payment from the <br />Contractor in the amounts specified below as liquidated damages for <br />failure of the Contractor to fulfill its obligations. <br />The following acts or omissions shall be considered a breach of the <br />Agreement: <br />Missed Curbside Collection <br />a) <br />$50 for each missed collection above two misses per <br />collection day, to be assessed at the end of each collection <br />month. A missed collection would be defined as a report by a <br />resident that their material was out by 7:00 a.m. and the <br />address did not appear on the Contractor's conveyance sheet <br />as a "Late Set Out” and the recyclables were properly sorted. <br />Missed Walk Up Collection <br /> b) <br />$50 per missed collection address above two misses at that <br />address in any four consecutive collection weeks. <br />Missed Multi Family Complex Collection <br /> c) <br /> $50 per missed collection <br />Failure to Collect Material on aBlock <br />d) <br />$500 for each incident of the Contractor failing to pick up <br />material on a block. A missed block is defined as one side of <br />a street between cross streets or an entire cul de sac where <br />residents from at least three households on that street report <br />that they had their material out before 7:00 a.m., the material <br />was not picked up, the recyclables were properly sorted, and <br />the addresses did not appear on the Contractor's conveyance <br />sheets as "Late Set Outs.” <br />Failure to Collect an EntireZone <br />e) <br />$1,000 for each incident of failure to complete collection of a <br />35 <br /> <br />
