4.0 REVIEW of REQUEST: <br />4.1 The initial request by ACR Homes sought support to allow the inclusion of an adult day <br />Care within their retail strip center at 2435 — 2459 Rice Street. However, after completing <br />historical research on the property to determine zoning and use approvals, the Roseville <br />Planning Division determined that on April 13, 1987, the City Council approved a <br />Special Use Permit for a Planned Unit Development for the Shelard Group on the subject <br />property and subject to 11 conditions. <br />4.2 Further research concluded that the subject property has an underlying zoning designation <br />of B-2, Retail Business District and is designated "B", Business in the Roseville <br />Comprehensive Land Use Plan. <br />43 The next step in the process was to meet with the City Attorney to determine what course <br />of action was necessary to allow an adult daycare (or other compatible uses) within the <br />existing strip center. The meeting with the City Attorney concluded that the proposal <br />would require an AMENDMENT to the PLANNED L1NIT DEVELOPMENT approved <br />in 1987 and require the establishment of a PLANNED LJNIT DEVELOPMENT <br />AGREEMENT that identifies specific terms and conditions. <br />4.4 Under a zoning designation of B-2, Retail Business District, a commercial daycare center <br />is allowed as a conditional use. <br />5.0 STAFF COMMENTS: <br />5.1 In 1987 this property was approved by the City of Roseville as a SPECIAL USE PERMIT <br />for a PLANNED LJNIT DEVELOPMENT — which specifically approved a <br />gas/convenience store and other office/retail/restaurant uses. Some time thereafter the <br />premises included the Power House Gym a use (health/fitness club) that appears to have <br />been supported by the City — no records indicate any land use violation. <br />5.2 Further research concludes that the property has a base zoning of B-2, Retail Business <br />District — actually the site was identified with this designation on our zoning and <br />address/zoning maps up until last fall when the Planning Division began and created a <br />planned unit development map that attempts to map/identify all planned unit development <br />sites in Roseville. <br />5.3 For those who are not familiar with a planned unit development zone — it is an overlay <br />district which relies on specific terms and conditions within an agreement to guide and <br />restrict development on a given parcel. Under the standard planned unit development <br />process there would be a rezoning that included a consistency review of the proposal with <br />the Comprehensive Plan, compatibility review of zoning, and review of impacts (such as <br />traffic and additional permitted uses) is necessary.
