5.2 When revie�ving requests for vacating public easements or public right-of-way, the <br />Public Works/Engineering Department determines whether the request will, immediately <br />or in the future, be an impact the general health, welfare or safety of the citizens of the <br />City of Roseville. <br />5.3 In the case of a sanitary sewer easement vacation there needs to be a determination of <br />whether an easement is necessary, whether it makes prudent sense to relocate the <br />easement, whether the percentage of gradient of the pipe would be compromised, and <br />whether an appropriate new easement can be created. <br />5.4 In the case of a street vacation there needs to be a determination of whether said street <br />right-of-way is or will be necessary to facilitate the distribution of traffic in a <br />neighborhood, whether existing public utilities lie underneath the right-of-way, and how <br />best to retain an easement protecting the public interest. <br />5.5 In the case of both the SANITARY SEWER EASEMENT and STREET RIGHT-OF- <br />WAY VACATIONS sought by the applicant, the Public Works/Engineering Department <br />has deternuned that the interests of the public will not be compromised by vacating the <br />easements. Specifically, the sanitary sewer that lies on a portion of Lots 14 through 19, <br />Block 4, Rolling Green can be relocated without impact to the existing system, can be <br />rebuilt at a proper gradient, and the new easement can be provided at the required width <br />(20 feet) and in a location that will not cause other potential land use impacts in the <br />future. Further, and specific to the STREET RIGHT-OF-WAY VACATION, Chandler <br />Avenue has not been developed near this segment of right-of-way and there are no plans <br />to construct a public roadway in this location; therefore the existing right-of-way is <br />deemed unnecessary and may be vacated without compromising the public interest. <br />6.0 RECOMMENDED CONDITIONS: <br />The following are staff-recommended conditions for approval of Moore's McCarrons <br />Preserve: <br />6.1 The applicant must work with City Staff on the preservation of mature, high-quality trees <br />at or near the periphery of the property. The applicant must submit a tree preservation <br />plan (taken from the tree inventory survey) indicating all trees, 8-inch caliper and larger, <br />which are to be preserved during grading and home construction; this plan must be <br />reviewed and approved by the Roseville Development Review Committee prior to the <br />issuance of a permit. <br />6.2 The applicant must include on the Final Plat a 10-foot-wide utility and drainage easeinent <br />around the periphery of the subject parcel and 5-foot-wide utility and drainage easements <br />between each new lot. <br />63 The applicant must provide the appropriate easement for the relocated public sanitary <br />sewer line. <br />PF3759_RPCA_090606 Pane 3 of 4 <br />
