Thomas and Julie McDaniel Page 2 <br />Variance Board Appeal <br />Wetland Jurisdiction <br />Wetlands are under two jurisdictions in Minnesota: State and Federal. While other wetland <br />areas within Owasso Hills are listed, there are no wetlands on our property listed at the State <br />level (Dep't of Natural Resources Protected Water Inventory of Ramsey County) or Federal <br />level (National Wetlands Inventory). This data is from research conducted by Aquatic <br />Ecosolutions, Inc, who we contracted to delineate the new storm water retention boundary. <br />Summary <br />The area behind our home has wetland type characteristics (vegetation, soils, hydrology) and <br />we strongly support reasonable protection of such areas. However, due to storm water <br />ponding requirements, the "wet" area has significantly expanded. City Staff has <br />recommended that when a wetland is expanded due to usage as a storm water pond, the 50 <br />foot setback requirement be taken from the previously dlineated boundary. Based on the <br />drawings/documents presented and utilized when purchasing this lot and building our home, <br />the proposed IS'x18' expansion is significantly outside the 50 foot setback. Also, by <br />specific design, the expanded "wet" area is due to stortn water retention. City Code requires <br />a 30 foot setback from storm water retention areas. The proposed expansion to our home <br />would be a full 35 feet from the newly delineated storm water boundary. <br />This is a very unique situation with specific history and many relevant points.
