These Councilmembers were more comfortable with the idea of <br />approving the outdoor storage as an interim use (as it was in 2004) so that the approval would <br />not inadvertently become an obstacle to redeveloping the property at some time in the future; to <br />that end, they tabled the conditional use request and asked Planning Division staff to discuss with <br />you the possibility of withdrawing the current conditional use request and applying instead for <br />approval of the outdoor storage as an interim use. <br />Minnesota Statute 15.99 requires the City of Roseville to formally approve or deny your <br />conditional use request within 60 days of the date of your application. I received the application <br />on September 11, 2009, which means that Roseville has until November 10, 2009 to take formal <br />action. Although the City Council could still reach a decision on your request at its meeting of <br />November 9, 2009, it's possible that we will not have resolved by that time the question of <br />whether you prefer to withdraw the current conditional use application or to continue to seek the <br />Council's approval. <br />To deal with a situation in which we need to answer questions like this that were not anticipated <br />earlier on, Minnesota Statute 15.99 also allows the City one opportunity to extend the time <br />allowed for final action approving or denying your request for an additional 60 days. Since it's <br />unclear whether the City Council will be taking final action on your request within the original <br />60-day timeframe, the intent of this letter is to notify you that the time limit for final action on <br />your conditional use request is being extended. While Roseville now has until January 9, 2010 to <br />finally approve or deny your conditional use request, we have no interest in the process lasting <br />that long.
