Regular City Council Meeting <br /> Monday,August 12, 2013 <br /> Page 12 <br /> cilmember McGehee questioned if striking areas of outdoor "storage," services or <br /> manufacturing was in error. <br /> Related to opacity, Mr. Paschke advised that, while the existing ordinance may re- <br /> fer to opacity at 85%, the 95% was an attempt to get closer to 100% opacity, but <br /> still allowing for other types of screening materials than wood that may be more <br /> practical or cost effective in industrial areas versus building wooden fences. Mr. <br /> Paschke advised that this could allow for other types of netting and provided <br /> greater flexibility for staff to work with individuals on the best screening material <br /> for their particular situation. As an example, Mr. Paschke used the AirGas site off <br /> Walnut Road adjacent to Meritex; with their screening application providing al- <br /> most 100% opacity, but still able to be seen through, but appropriate in an indus- <br /> trial situation. Mr. Paschke cautioned that such a material may not be so appro- <br /> priate in other situations. <br /> From his perspective, Mayor Roe opined that from an enforcement point of view, <br /> 95% opacity did not mean 95 out of 100 feet screened completely and 5 feet com- <br /> pletely unscreened; the 95% opacity requirement had to be achieved over any por- <br /> tion of the fencing. As an example, Mayor Roe used several photos included in <br /> packet materials (pages 4 and 5). <br /> Related to Councilmember McGehee's question about outside storage of loose <br /> materials in an Office/Business Park, Mr. Paschke noted that the rationale for that <br /> language was to recognize that an Office/Business Park use is not traditionally in- <br /> dustrial in nature. Mr. Paschke opined that those areas would not typically see <br /> loose materials (e.g. aggregate or shingles) stored outside; but if a situation arose <br /> and additional screening was indicated to screen those materials adjacent to an- <br /> other office building, approval could be granted and/or denied based on a Condi- <br /> tional Use application. <br /> Councilmember McGehee proposed not permitting outdoor storage of loose mate- <br /> rials in a zoning district designated Office/Business Park; opining that those mate- <br /> rials were not reasonable in such an area, but rather in an industrial area. <br /> Mr. Paschke responded by noting that there were already pre-existing uses that <br /> became legal, non-conforming when the Zoning Ordinance was changed in 2010 <br /> creating the Regional Business District. <br /> Councilmember McGehee asserted that just because something was an existing <br /> use in the Business Park did not create the need to change code to propagate or <br /> extend that existing use versus letting those grandfathered uses expire or change <br /> to eliminate that particular type of storage in a Business Park if guided toward a <br /> different future use. <br />
