BACKGROUND <br /> <br />This application was continued from the September meeting. The <br />principal reason for the continuance was that the certified list of <br />surrounding property owners was incomplete, which rendered the <br />notification for the public hearing invalid. <br /> <br />In moving to continue this hearing, the Planning Commission also <br />informed the applicants that they were very concerned about the <br />proposed hours of operation and directed staff to review this matter <br />with the Police Department. The applicants have changed their <br />proposed hours of operation to close at 11:00 p.m. on week nights and <br />midnight 0 n Friday and Saturday. <br /> <br />Also attached for your review is a memorandum from Police Chief Jim <br />Zelinsky to Rick Jopke. The memorandum summarizes the record of <br />experience related to the Circus facility at Har Mar Mall, and transmits <br />the findings of inquiries of ten other police departments. Please be <br />careful to note which of these inquiries relate specifically to a business <br />owned by the same applicants. <br /> <br />2. SUMMARY AND RECOMMENDATIONS <br /> <br />Virtually everyone of the police departments contacted for the survey <br />expressed some negative experience with arcade type uses. It should <br />also be noted that some did have positive things to say about the Skill <br />Mill management. It seems that the consensus is that they do a good <br />job of controlling their clientele while they are in the facility, but do <br />not control them out on the site. <br /> <br />Remember that special use permits run with the land and that they are <br />issued to the property owner. It appears from this survey that some <br />additional security outside the building may be needed. If you believe <br />that additional security personnel or procedures are necessary to make <br />this use acceptable, you could condition a recommendation on additional <br />security. <br />
