BACKGROUND <br /> <br />This is an application for an interim use permit to allow <br />a truck repair business on the Ruan property located at <br />2140 West County Road C. The subject property is guided <br />for Business use and it is zoned B-4 Retail Office <br />Commercial. Truck repair is not allowed as either a <br />permitted or conditional use in the B-4 District. <br /> <br />The Ruan property has been the focus of much attention <br />over the past several years. Dillon Inn was proposed on <br />the site in 1984, but that application was withdrawn at <br />the Planning Commission level. More recently we have met <br />with a number of interested parties and the Economic <br />Development Department is actively involved in discussions <br />with major national development companies regarding this <br />. property and the neighboring redevelopment area. <br /> <br />The most recent proposal we have seen called for a small <br />strip center with some three small freestanding pads. <br />These pads were the size that normally accommodate <br />fast-food restaurants, and the proposers agreed that one <br />of their proposed users is an Arby's restaurant. <br /> <br />We explained to these individuals that restaurants smaller <br />than 5,000 square feet are not allowed as either permitted <br />or conditional uses in the B-4 District. We have not <br />heard from them since that initial meeting approximately <br />45 days ago. <br /> <br />The point in this discussion is that although there is <br />activity underway that is focused on the development of <br />the Ruan property, it currently remains vacant. The <br />applicant in this case, David Brainard, wants approval to <br />operate a truck repair business on the site. The Ruan <br />people would continue to attempt to sell the property and <br />
