BACKGROUND <br /> <br />At the City Council meeting of February 25, 1991, the <br />Council approved an amendment to the Special Use Permit <br />for the Rosedale Commons Shopping Center to consolidate <br />some tenant spaces and change some internal use areas <br />within the shopping center. These changes also included <br />the need to build a loading dock and trash enclosure. <br /> <br />Part of the agreement involved resolution of the issue of <br />a fence along the Shopping Center's northern property line <br />adjacent to the residential neighborhood on Oakcrest <br />Avenue. It was acknowledged at both the Planning <br />Commission and City Council meetings that while the <br />approval of this fence would require some variances, it <br />would be a long-term benefit for both the owners and <br />neighboring residents. A petition signed by all of the <br />adjacent residents was provided to the City council. <br /> <br />2. DEVELOPMENT ANALYSIS <br /> <br />The developer, Tanurb, proposes to build a 14-foot high <br />wood fence, the cost of which will be shared with the <br />City. The fence requires a variance to the height limit <br />for fences. <br /> <br />Approval of this proposal will also constitute an <br />amendment to the special use permit for site plan <br />approval. In addition, it will require a variance to the <br />requirement that screen walls be constructed of the same <br />materials as the principal structure. Although a <br />comprehensive analysis has not been performed, the loading <br />area may not meet the letter of the standard of being <br />totally screened (except at driveways) from the ground <br />
