<br />State of Minnesota. Such Option shall be subject to the terms and <br />conditions hereinafter set forth. <br /> <br />Section 2. Duration of Ontion. The Option will expire on that date <br />which is seven years after the date upon which this Declaration is <br />recorded. There are no circumstances that will terminate the Option <br />before the expiration of said seven year period. However, the Declarant <br />or anyone to whom Declarant has assigned said Option as hereinafter set <br />forth, may terminate said Option as to all or a portion of the Additional <br />Real Estate above described by executing a writing to such effect and <br />recording the same in the same manner as a deed of the Additional Real <br />Estate so affected. <br /> <br />Section 3. Timin~. Portions of the Additional Real Estate may be <br />added at different times and in any order. <br /> <br />Section 4. Buildin~s. Any improvements that may be erected upon <br />any Additional Real Estate which is added to the Property will be <br />compatible with the improvements originally constituting a part of the <br />Property in terms of architectural style, quality of construction, <br />principal materials employed in construction, and size. <br /> <br />Schedule 5. Applicability of Restrictions. All restrictions in <br />this Declaration affecting the use, occupancy, and alienation of the <br />Property will apply to any Additional Real Estate which is added to the <br />Property. <br /> <br />Schedule 6. No Assurances. Nothing herein contained shall bind the <br />Declarant to add any portion of the Additional Real Estate to the <br />Property or to adhere to any particular plan of development or <br />improvement for any portion of the Additional Real Estate not added to <br />the Property. None of the assurances set forth in Sections 4 or 5 above <br />will apply to any Additional Real Estate which is not added to the <br />Property. <br /> <br />Section 7. Exercise of Ontion. Declarant may exercise its option <br />to add all or a portion of the Additional Real Estate by filing for <br />record in the office of the Ramsey County Recorder a supplementary <br />declaration with respect to the Additional Real Estate being added. <br /> <br />Section 8. Assi2nment of Ontion. The Option may be assigned by <br />Declarant insofar as it affects any portion of the Additional Real Estate <br />to the owner of any such Additional Real Estate, if other than the <br />Declarant. Any such assignment shall be in writing, shall be recorded <br />among the real estate records in the same manner as a conveyance of the <br />Additional Real Estate and shall be subject to all of the terms and <br />conditions of this ARTICLE XI. <br /> <br />-22- <br />
