BACKGROUND <br /> <br />Last fall Virginia Tschida was granted a lot division that split <br />off a piece of her property on Western Avenue near S. Owasso <br />Boulevard, which she sold to Sam Cave. At last month's planning <br />Commission meeting Sam Cave presented his request for a four-lot <br />subdivision of this property. Concerns were expressed by virginia <br />Tschida's son, Frank, about whether the remaining Tschida property <br />could be developed if the Cave plat were approved. There was also <br />concern about the engineering and safety issues associated with <br />access to Western Avenue. The Commission continued the <br />consideration of the application to this month in order to address <br />these issues. <br /> <br />When this area was platted in 1974 as the Tschida Owasso Hills <br />Plat No.3, a large outlet was reserved for Mrs. Tschida's home <br />and property, but a sketch was drawn showing how it might <br />ultimately be developed (see attached). This involved the <br />platting of a stub of stanbridge Circle off of Farrington Avenue. <br />Stanbridge Circle would then be a cul-de-sac serving ten lots. <br />In this plan, no lots would access Western or S. Owasso. <br /> <br />At the time of Virginia Tschida's lot split last year, the lots <br />were analyzed and it was determined that the Cave parcel could <br />support four single family lots with access to Western Avenue, <br />with certain conditions, given their location on the Western <br />Avenue curve. The lot split was granted (to Mrs. Tschida, not Sam <br />Cave) with the full understanding that the Cave parcel would be <br />allowed access off of Western Avenue. <br /> <br />We told the Planning commission last month that access internally <br />for the Cave parcel was preferable to access of Western, but that <br />this was not possible without the cooperation of the Tschidas. <br />without that cooperation, Sam Cave is entitled to a fair <br />consideration of his plat.
