ACTION

DATE: 5-2~q~

ITEM NO.: P-4

Department Approval:

Manager Reviewed:

Agenda Section:

Hearings

Item Description:

James Westby request for vacation ofright~of-way easement,
division of platted lot, and rezoning from R-l to R-2 at 480 Lovell
Avenue and Vietnamese Buddhist Association request for
vacation of right-of-way at 475 Minnesota Avenue..

Backi!round

1. Mr. Westby lives at 480 Lovell Avenue in Roseville and owns a parcel of land
south of Lovell Avenue, west of his residence to the property line with the
Rottlunc1JConcordia Meadows townhome project. The parcel is directly north of
the Buddhist Temple. The property was acquired in 1967 and, at that time, an
easement for possible future streets was granted in favor of the City. The need for
such a street does not exist and in fact, a single family residence blocks access to
Minnesota Avenue on the south.

2. Therefore, Mr. Westby and the Buddhist Temple are seeking to have that
easement vacated. In addition, Mr. Westby is proposing to divide the parcel to
the west of his residence into two developable lots and further proposing that the
lot adjacent to the Concordia Meadows Planned Unit Development be rezoned to
R-2 in order to build a double bungalow for his mother-in-law and her sister.

3, As indicated earlier, the Westby's live at 480 Lovell Avenue in Roseville. That
parcel is located on the south side of Lovell and is approximately 1/2 acre in size.
In addition, they own a parcel of land innnediately to the west that is
approximately .65 acres in size. In 1967) a 50 foot wide easement was recorded
along the Westby's westerly property line, extending southerly along a portion of
the Buddhist Temple property, At that time, the easement was dedicated in
anticipation of a possible north/south street between Lovell Avenue and

1
