<br />18.050 General Design Criteria For Structures. <br /> <br />18.050.1 Low Floor Elevations. All habitable structures constructed within the overlay district <br />shall be built with their lowest floor, including basement, no lower than the following elevation <br />criteria, which ever provides the greater degree of protection as determined by the city engineer: <br /> <br />1) two feet above the 100 year flood elevation, if known; or <br /> <br />2) at least three feet above the highest known water level, or three feet above the ordinary <br />high water level, whichever is higher; or <br /> <br />3) at least three feet above the wetland boundary as defined in Section 18.020.53. <br /> <br />The city engineer shall develop and maintain a list of elevations of known 100 year flood levels, <br />ordinary high water levels, highest known water levels and wetland boundary levels as they <br />become available through special studies or the Minnesota Department of Natural Resources. <br /> <br />18.050.2 Low Floor Elevation Exceptions. A variance may be granted from the elevation <br />requirements specified in 18.050.1 (above) only where a hardship is determined and provided the <br />structure is flood-proofed according to state and federal standards for floodplain areas. <br /> <br />Water-oriented accessory structures may have the lowest floor placed lower than the elevation <br />detennined in Section 18.050.1 if the structure is constructed offlood-resistant materials to the <br />elevation, electrical and mechanical equipment is placed above the elevation and, iflong duration <br />flooding is anticipated, the structure is built to withstand ice action and wind-driven waves and <br />debris. <br /> <br />18.050.3 Permitted Water-oriented Accessory Structures. Each lot may have one <br />water-oriented non-habitable accessory structure not meeting the normal structure setback in <br />Section 18.045.2 ofthis code if this water-oriented accessory structure complies with the <br />following provisions: <br /> <br />(1) Water oriented accessory structure dimensional requirements. <br /> <br />Maximum floor area <br /> <br />250 sq. ft. <br />12 feet <br />10 feet <br /> <br />a) <br />b) <br /> <br />c) <br />d) <br /> <br />e) <br /> <br />Maximum width as viewed from water <br />Maximum Height <br />Setback from ordinary high water <br />Boathouse setback ITom ordinary high <br />water level <br /> <br />* <br /> <br />10 feet ** <br /> <br />t) <br />g) <br /> <br />Side yard setback from property line <br />Detached deck height above grade <br /> <br />8 feet <br /> <br />20 feet <br /> <br />14 <br />
