<br />18.090.3 A permit from the City Council is required for any projects meeting the following <br />criteria. <br /> <br />1) Any fill, grading, or drainage of a public water or a wetland, provided the City Council <br />first determines that the project is either exempt from the 1991 Wetlands Conservation <br />Act or certifies the replacement of any loss of wetland area, values and functions in <br />accordance with Minnesota Rules Chapter 8420 as amended. Questions relating to <br />wetland type, location, area, functions and values must be referred to the technical <br />advisory panel established by Minnesota Statutes Section 103G.2242 as amended. <br /> <br />2) For any filling or excavating on developed land zoned R-l or R-2 where the site is less <br />than 1 acre and the fill or excavation exceeds 500 cubic yards. <br /> <br />3) For any filling or excavating on developed land zoned R-l or R~2 where the site is one <br />acre or greater and the proposed fill/excavation exceeds 1,000 cubic yards. <br /> <br />4) For any filling or excavating on undeveloped land zoned R-l or R-2 where the site is less <br />than one acre and the proposed fill/excavation exceeds 2,000 cubic yards. <br /> <br />5) For any filling or excavating on undeveloped land zoned R-l or R-2 where the site is <br />greater than one acre and the proposed fill/excavation exceeds 4,000 cubic yards. <br /> <br />6) For any filling or excavating on developed commercial/industrial property where the site is <br />less than 2.5 acres and the proposed fin/excavation exceeds 2,500 cubic yards. <br /> <br />7) For any filling or excavating on developed commercial/industrial property where the site is <br />greater than 2.5 acres and the proposed fill/excavation exceeds 5,000 cubic yards. <br /> <br />8) For any filling or excavating on undeveloped commercial/industrial property where the site <br />is less than 2.5 acres and the proposed fill/excavation exceeds 5,000 cubic yards. <br /> <br />9) For any filling or excavating on undeveloped commercial/industrial property where the site <br />is greater than 2.5 acres and the proposed fill/excavation exceeds 10,000 cubic yards. <br /> <br />18.090.4 All applications for permits for grading and filling activities or land disturbances within <br />the overlay district resulting in more than one acre of exposed soil shall be accompanied by plans, <br />specifications, and completion schedules in conformance with the ItRamsey County Erosion and <br />Sediment Control Handbook" prepared by the Ramsey Soil and Water Conservation District, <br />1989 as amended. <br /> <br />18.090.5 All building permits involving any excavation, fill or grading shall contain special <br />provisions that specify; <br /> <br />I) that the permittee is responsible for the cleanup and any damages resulting from soil <br />eroded from the building site onto public streets and storm sewer system and/or any <br />adjoining private property; and <br /> <br />2) that the permittee shall install and maintain either silt fencing along the lot boundaries <br /> <br />24 <br />
