<br />18.260 <br /> <br />ZONING CODE <br /> <br />18.260. Variances From standards. <br />In any case where, upon application of any responsible parties <br />to the City council, it appears that by reason of exceptional <br />circumstances the strict enforcement of any provision of the <br />standards would cause unnecessary or that strict conformity with <br />the standards ~ould be unreasonable, impractical or not feasible <br />under the circumstances, the City council may permit a variance <br />therefrom upon such conditions as it may prescribe for <br />management of shorelands consistent with the general purposes of <br />this chapter, and the ~ntent of this and all other applicable <br />state and local regulations and laws provided that: <br /> <br />1. The condition causing the hardship is unique to that <br />property. <br /> <br />2. The variance is proved necessary in order to secure for the <br />applicant a right or rights that are enjoyed by other owners <br />in the same area or district. <br /> <br />3. The granting of the variance will not be contrary to the <br />public interest or damaging to the rights of other persons <br />or to property values in the neighborhood. <br /> <br />4. No variance shall be granted simply because there are no <br />obj ections or because those who do not obj ect outnumber <br />those who do, nor for any other reason than a proved hard- <br />ship. <br /> <br />18.270. Enforcement. <br />1. This chapter shall be administered and enforced by the Chief <br />Code Enforcement Officer, who is hereby designated the <br />enforcing officer. <br /> <br />2. In the event of a violation or a threatened violation of <br />this chapter the city Council, or any member thereof, ir <br />addition to other remedies, may institute appropriatE <br />actions or proceedings to prevent, restrain, correct 01 <br />abate such violations or threatened violations, and it shalJ <br />be the duty of the City Attorney to institute such action. <br /> <br />3. Any taxpayer or taxpayers of the city may institute mandamu! <br />proceedings in the District court to compel specific <br />performance by the proper official or officials of any dut: <br />required by this chapter. <br /> <br />4. Any person, firm or corporation who shall violate any of th <br />provisions hereof, or who shall fail to comply with any 0 <br />the provisions hereof, or who shall make any false statemen <br />in any document required to be submitted under the provi <br />sions hereof, shall be guilty of a misdemeanor and, upo <br />conviction thereof, shall be punished by a fine not t <br />exceed $700.00, or by imprisonment not to exceed ninety (90 <br />days, or both. Each day that a violation continues shal <br />constitute a separate offense. <br /> <br />112 <br />
