These units take their access from Terrace Court and are bounded on <br />the north by a protected wetland area and on the south by existing single family <br />residential lots fronting on lona Lane. The planned unit development and attached <br />plans indicate that the rear yard setback distance, between the south property line <br />and the rear of units 13-20 is approximately 25 feet. This site plan was adopted <br />May 8, 1995. <br /> <br />In order to maintain proper setback from the wetland and accommodate the street <br />and approved townhouse units in this area, it appears that 4 of the buildings will <br />need to encroach into the southerly setback by 1 foot 6 inches. Section 1008.07, <br />paragraph A of the Planned Unit Development ordinance, provides that minor <br />changes in the location, placement and height of structures may be authorized by the <br />Development Review Committee, if required by engineering or other circumstances <br />not foreseen at the time the fmal plan was approved. This minor variation is clearly <br />consistent with this provision of the code. <br /> <br />Following staff consideration, it has been determined that the 1 foot 6 inch <br />encroachment into the south setback for townhouse units 13-20 is an approved <br />minor change to the Owasso Hills Planned Unit Development. The excessive depth <br />of the lots fronting on lona Lane, the grade separation from the existing residential <br />and the proposed townhouse development and the proposed developer landscaping, <br />combined offset any impact this minor change would have. <br />
