Mike <br />indicated that because the project is a Planned Unit Development, the setback requirements are <br />controlled by the approved PUD plans and Development Agreement. He reviewed the <br />Development agreement and found no specific rear yard setback other than by reference to the <br />Site Plan adopted May 8, 1995. This site plan shows the rear setback distance between the south <br />property line and the porch or deck portion of units 13 - 20, at approximately 25-feet. <br /> <br />Based on his review of the PUD Agreement and our discussion of the setbacks shown on the <br />plan, Mike determined that the approved setback for the units in question is 25 feet to the <br />porch! deck. <br /> <br />In Mike's official opinion, your request for a 11- 611 encroachment into this setback represents a <br />minor change in the location of the units needed to adjust to drafting, site surveying and <br />construction tolerances and that this minor change is justified and needed to implement the plan <br />as approved. <br /> <br />Mike indicated that you should submit your plans for building permits for these units, requesting <br />the necessary reduced setbacks, and that the City will review and approve the discussed reduction <br />as a minor change through the PUD ordinance and will then document their action for the file. <br /> <br />cc: Mike Falk <br />
