Johnson moved, Mastel seconded, that Independent School District 623 request for Planned Unit Development Final Land Use Development Plan and Agreement be approved with the following conditions, subject to review by the city Attorney, approval by the city Manager, and signature by the Mayor: 1. That all wetlands be platted as out lots and deeded to the city, and easements shall be provided for the maintenance of all NURP basins and drainage improvements. That trail connections be provided to the neighborhood park from the proposed sidewalk along the main through street in the development, and to provide access to the Judith Avenue neighborhood. These trails shall be dedicated on the plat as pedestrian rights-of-way and the specific locations and design shall be determined in co- operation with the Parks Commission and staff. That the applicant shall cooperate with the staff and Peter Gryskewicz in the process of evaluating the City's purchase of his property for storm water ponding purposes. If the City chooses not to acquire this property and Mr. Gryskewicz decides to pursue its development as a single family residential lot, the applicant has volunteered to grant an access easement to serve this lot. That any reduction in the size or changes to the shape of the neighborhood park that would result in an increase in the number of lots shall return to the Planning commission for review. That the proposed cul-de-sacs in the townhome areas shall be 28 foot streets located within 60 foot rights-of-way. The cul-de-sacs shall be modified to a "tear drop shape" to facilitate maintenance, and be located on 120 foot wide rights-of-way. That one side of 28 foot streets be posted for "No parking".
