The CONTRACTOR shall not make any'substitution for <br />any Subco~tractor who has been accepted by ,the OWNER and the <br />ENGINEER, unless the ENGINEER determines l.that1 there is gO,od <br />cause for so doing. <br /> <br />The CONTRACTOR shall be fully respoi)sible'for all ac1;is and <br />omissions of his SUbcontractors' and bf persons ,directly or <br />indirectly employed by extent that he is responsible "for the <br />acts and omissions of persons directly employed' by him. The <br />OWNER shall have no obligation to payor be responsible for <br />the payDient of any monies to any Subcontractor. " <br /> <br />The divisions or seotions of the Specifications 'or the, <br />identifications of any drawings shall not control the CONTRACTOR <br />in dividing the Work among Subcontractors or delineating the <br />Work to be performed by any trade. <br /> <br />The CONTRACTOR shall specifically bind every Subcontractor to <br />all of the applicable terms and conditions of the Contract <br />Documents. ,Every SUbcontractor, by undertaking to perform any <br />of the Work, will thereby automatically be'deemed to be bound <br />by such terms and conditions. <br /> <br />WORK BY OTHERS <br /> <br />The OWNER may perform additional Work related to the Project by <br />himself, or he may let other direct contracts therefore which <br />shall contain, General Conditions similar to 'these. The. <br />CONTRACTOR shall afford the other contractors who are parties to <br />such direct contracts (or the OWNER, if he is performinq the <br />additional work himself), reasonable opportunity fo:r the intro- <br />duction and storage of materials and equipment and the. execution <br />of work, and shall properly connect and coordinate his work with <br />theirs. <br /> <br />If any part of the CONTRACTOR'S Work depends, for pr~per <br />execution or results upon the work of any such other contractor <br />(or the OWNER), the CONTRACTOR shall inspect and promptly report <br />to the-ENGINEER in writinq any defects or deficiencies in such <br />work that renders it unsuitable for such proper execution and <br />results. <br /> <br />His failure to do so shall constitute an acceptance of the other <br />work as fit and proper for the relationship of his Work as to <br />defects'and,deficiencies which may appear ~n the other wor~ <br />after the executiqn of his Work. ' . <br /> <br />The CONTRACTOR shall do all cutting, fitting and patching of his <br />Work that may be required to make its several parts come , <br />together properly and fit it ~o re~eive or be receive~ by such <br />other work.
