12. 13. 14. The use of frozen materials in the backfilling of the pipe will not be permitted. The portion of the backfill hand placed and tamped around the pipe shall be dry, granular material which can be brought to proper density prior to freezing. PERMITS Whenever any work is to be constructed within any right-ot- way or beneath any road bed of any Railroad Company or any state or County Highway, i~ shall be the contractor's responsibility to obtain the necessary application forms and permits as required by the proper officials in charge of such installations for the Railroad Company, state or County Highway Department prior to construction in said right-of- way. To expedite receipt of certain permits, the Engineer may submit some permit applications prior to bidding. In doing so, certain assumptions will have been made, i.e., thickness and diameter of casing pipes, etc. The Contractor will be responsible for any alterations and obtaining written permission or a new permit for that alteration from said department. The Contractor shall furnish at no additional compensation, any and all insurance or inspection as required by any department. This shall include any railroad protective liability policy requirement for work in railroad right-of- way. No additional compensation will be made to any Contractor for the pipe or method of construction or the installation of the same beneath or across any right-of-way or state Highway, and the extra cost of such installation shall be paid for by the Contractor and shall be included in his contract price. DEWATERING No pipe or appurtenances shall be laid in water or a wet trench. All costs incurred for any dewatering necessary obtain a dry trench condition is considered as merged in unit prices bid under those contract items requiring dewatering and no additional compensation will be paid. Contractor is encouraged to obtain his own soil borings verify the water conditions prior to bidding. The Minnesota Department of Natural Resources require permits for temporary withdrawal of ground water based on daily volume pumpage.
