<br /> <br />City Ordinance: <br /> <br />City ordinances indicate that beauty parlors with one operator, which see customers by <br />appointment only are uses allowed by conditional use permit in the R-l Zoning District. The <br />ordinance also indicates that beauty shops must meet the restrictions outlined in the home <br />occupation section of the code which limits the home occupation to one room in the principal <br />dwelling, prohibits the employment of any persons not residing in the residence, and prohibits <br />retail or wholesale product sales on site. The ordinance also states that the Council may approve <br />the equipment used. Ms. Pittroff has indicated that she will abide by all the ordinance <br />requirements. <br /> <br /> <br />Prooosed Develooment: <br /> <br />2 <br /> <br /> <br />Ms. PittrofI's proposed operation will not be a commercial or business use in the normal sense of <br />the word. With one operator and one customer at a time by appointment only, the disruption to <br />the neighborhood will be minimal. Home occupations are not an encroachment of typical <br />commercial activity into a neighborhood. In past considerations of requests for conditional use <br />permits for one operator beauty salons in residential districts, the Planning Commission has <br />considered the following additional conditions of approval: <br /> <br />1. Defining the hours business is conducted during the week. <br />2. Stipulating that there shall be no more than two client cars at a time and that those cars <br />must be parked off street. <br />3. That the conditional use permit is issued to the applicant only and shall automatically <br />expire upon the sale of the property. <br />4. That there shall be no product sales on the site except for sale of products to individuals at <br />the time the service is rendered if appropriate. <br />5. That there shall be no other employees providing service and that the business shall not <br />occupy more than one room of the house. <br />6. That the structure must meet life safety, exiting criteria of the City Codes. <br />7. That the non-lighted sign be no more than 3 square feet. <br />S. That non-compliance by the applicant with any of the conditions can be grounds for <br />immediate revocation of the conditional use permit. <br /> <br />Ene:ineerine: Review: <br /> <br />Because there are no physical changes to the property, engineering staff review is not necessary. <br /> <br />Staff Recommendation: <br /> <br />Ms. Pittroff is seeking a conditional use permit to operate a one employee cosmetology salon in <br />her home at 1655 Stanbridge Avenue. Following notification of the hearing, a number of <br />neighbors have contacted City Hall. Of those who called, the majority were either in favor of the <br />
