<br />23. AIR AND WATER POLLUTION <br /> <br />Pollution of natural resources of air, land, and water by operations under this Contract shall <br />be prevented, controlled and abated in accordance with the rules, regulations and standards <br />adopted and established by the Minnesota Pollution Control Agency. The contractor shall <br />be responsible for dust control as an incidental item. <br /> <br />24. SITE MAINTENANCE <br /> <br />Maintenance of the streets and areas under construction, detours, by-passes and equipment <br />yards used in conjunction with the project shall be the responsibility of the Contractor. Said <br />maintenance shall include keeping the streets free of obstacles, and parked equipment, <br />barricades that are not in use, blading the traveled ways, and controlling the dust in the <br />construction area. <br /> <br />The Contractor shall be responsible for construction of all necessary temporary haul roads <br />required to complete the required excavation and disposal. Construction of temporary haul <br />roads shall also include placement of necessary granular material over existing bituminous <br />roadway surfaces. This material shall be of sufficient depth to allow for protection of <br />existing bituminous surfaces. Construction of necessary haul roads shall be considered an <br />incidental item to other construction items and no direct compensation will be made. <br /> <br />When dust becomes or appears to be becoming a nuisance or problem to the area or nearby <br />residents, it shall be the responsibility of the Contractor to immediately alleviate the <br />undesirable conditions. The maintenance responsibility herein described shall be inherent to <br />the Contractor and shall be applicable at all times, including weekends, throughout the <br />construction period. The Contractor shall provide periodic inspection of the project, <br />particularly during and after storms, to maintain blinker and barricades, provide dust and <br />erosion control and general maintenance. If the contractor is negligent in this respect, the <br />City reserves the right to perform this work with its own forces at overtime rates. <br /> <br />The costs of such work will be charged to the Contractor. Section 2130 of the specificati~ns <br />is hereby amended to provide that the Contractor shall furnish and apply all water necessary <br />on the project, including water used as dust palliative, washing of equipment, etc., and that <br />such water shall be considered as an incidental item to the Contract and no direct payment <br />will be made therefore. If the Contractor elects, he may use water from the City's water <br />distribution system at no charge, provided he makes suitable arrangements with the Water <br />Department. Water from private sources may be used only if permission has been granted <br />by the property owner. <br /> <br />-6- <br />
