<br />PLANNED UNIT DEVELOPMENT AGREEMEtfi <br /> <br />AGREEMENT, dated between the City of Roseville ("the City") and Lawrence <br />Aim, dba Southwinds of Roseville ("Developer"). <br /> <br />1. Request for Planned Unit Development Approval. <br /> <br />The DEVELOPER has asked the CITY to approve a Planned Unit Development consisting <br />of 30 townhome lots on 6 acres of land generally located south of County Road Band <br />adjacent to Albermarle Court. The subject property is legally described as follows: <br /> <br />See attachment A. <br /> <br />2. Planned Unit Development Approval. <br /> <br />The CITY hereby grants approval of the Final Development Plan and subject to the <br />DEVELOPER'S compliance with the terms and conditions of this agreement. The CITY <br />agrees to approve applications for building permits, provided that said plans are consistent <br />with the exhibits which were approved at the concept and final stage of the Planned Unit <br />Development process, and all of the conditions of this agreement have been satisfied. <br /> <br />3. Approval by the CITY. <br /> <br />The CITY hereby approves the Development as shown on the following exhibits. The <br />DEVELOPER shall develop the subject properties in accordance with the general plans <br />shown on the exhibits. If, however, the exhibits vary from the written terms of this <br />Agreement, the written terms shall control. The exhibits marked approved by the City <br />Council on March 24, 1997, or as amended thereafter, shall include: <br /> <br />A. Site plan. <br />B. Preliminary Plat. <br />C. Elevations. <br />D. Grading plan. <br />E. Utility plan. <br />F. Landscape plan. <br />G. City Street Tree Master Plantings. <br /> <br />- 1 - <br />
