<br />A. The principle use of each lot within the above described PUD shall be a single level <br />town home not exceeding 1,380 s.f., with basements and attached garages as <br />additional permitted space, but excluded from the total square footage allowed in <br />the unit. Garages shall be utilized for vehicle parking and shall not be converted to <br />additional storage or living space. The project may be designed and built in up to <br />4 phases. Each phase that changes from the original density by more than 1 unit <br />per acre, or significant design changes, shall be reviewed by the Planning <br />Commission. <br /> <br />B. All streets within the PUD development shall be public streets. The Developer shall <br />deed ownership of all Outlots and road right-of-ways within the plat to the City. <br /> <br />C. Sidewalks shall be constructed and paid for by the developer. A sidewalk shall be <br />installed on the south side of County Road B on right-of-way, or on additional <br />access easements dedicated by the developer, abutting all lots abutting County <br />Road B. <br /> <br />D. Park dedication requirements shall be satisfied by the contribution of cash in lieu of <br />land for each additional housing unit for which park dedication was not paid in the <br />original Zeece plat. Because the land is deemed unusable for park purposes, the <br />park dedication requirement (as cash in lieu of land) shall be based on $500.00 per <br />new single family lot and $400.00 per townhouse unit. <br /> <br />E. Prior to the commencement of site development activities by the DEVELOPER, the <br />DEVELOPER intending to commence activities shall have posted with the CITY a <br />landscape bond, a letter of credit, or other security acceptable to the City in an <br />amount equal to 150% of the cost of all site landscaping, street tree planting as per <br />. City Master Plan, and site restoration. The specific amount of this letter of credit, <br />bond, or other security shall be determined by the Community Development <br />Director, following the completion of all site construction plans. <br /> <br />F. The proposed cul-de-sacs in the townhome areas shall be a minimum of 28 foot <br />wide paved streets with concrete curb and gutter, located within 50 foot rights-of- <br />way with a 5 foot city access, utility, and planting easement on each side of the <br />street. The cul-de-sacs shall be modified to a tear drop shape to facilitate <br />maintenance and be located on 100 foot wide rig ht-of-ways , with a five foot city <br />access, utility, and planting easement on each side of the street.
