Request for P1at Approval <br /> <br />The Devetoper has asked the City to approve a pW of tand to be known as <br />Southwind6 of RoseviIe (atso referred to in this contract as the "plat'). The land is <br />tegany described as foflows: <br /> <br />The plat of SouthWind of Roseville, also legally descrbed as the East <br />25 feet of the SoU'th 138.50 feet of Lot 1, together with Lots 3, 4, 5, 6, <br />and 8 through 15, Block 1, ZEECE ADDfTtON, according to the <br />recorded plat thereof; and that part of Albemarte Court, as dedicated <br />in ZEECE ADDITION, Ramsey County, Minnesota, vacated per <br />Resolution No. 9407; gng Lot 1, Block 1, THORNTONS ADDITION, <br />according to the recorded plat thereof, except that part of the North <br />150 feet of said Lot 1 lying Easterly of the West 80 feet of said Lot 1 <br />and except the South 240 feet of said Lot 1 and except the East 147 <br />feet of said Lot 1; subject to easement. <br /> <br />2. Conditions of Plat Approval <br /> <br />The City Council approved the preliminary and final plat for Southwind of Rosevitle <br />and a ptanned unit development agreement for the project. <br /> <br />3. Effect of Subdivision Appmval <br /> <br />For two (2) years from the date of this Contract, no amendments to the City's <br />Comprehensive Plan, exoept an amendment placing the pfat in the current urban <br />service area, or official controls shall apply to or affect the use, development <br />density, lot size, tot layout or dedications of the approved ptat unless required by <br />state or federal raw or agreed to in writing by the City and the Developer. <br />Thereafter, notwithstanding anything in this Contract to the contrary, to the full <br />extent pennitted by state Jaw the City may requite compliance with any <br />amendments to the City's Comprehensive Guide Plan, official controls, ptatting or <br />dedication requirements enacted after the date of this Contract. <br /> <br />4.
