<br />Planned Unit Development #1179 Agreement <br />Page 4 <br /> <br />6. The DEVELOPER shall provide proper screening and landscape buffers between <br />the development and existing development as per approved landscape plan <br />received April 7, 1997. <br /> <br />7. The terms of purchase of CITY land must be approved by the City Council/Mayor <br />and City Manager after review by the City Attorney. <br /> <br />8. The storm water detention pond shall be constructed and maintained as per City of <br />Roseville and Central Ramsey Watershed Management Organization requirements <br />and permits. The DEVELOPER shall be responsible for any pond maintenance. <br />The slope of the pond shall not exceed 4H:1V. The proposed pond will be <br />constructed adjacent to existing utilities; therefore, the DEVELOPER shall protect <br />said utilities during construction and maintain adequate soil cover. <br /> <br />9. All new and replacement street trees shall meet the requirements of the City Street <br />Tree Master Plan attached as Exhibit G. <br /> <br />10. Prior to the commencement of site development activities by the DEVELOPER, the <br />DEVELOPER shall have posted with the CITY a landscape bond, a letter of credit, <br />or other security acceptable to the City in an amount equal to 150% of the cost of <br />all site landscaping, street tree planting as per City Street Tree Master PI~n, and <br />site restoration. The specific amount of this letter of credit, bond, or other security <br />shall be determined by the Community Development Director, following the <br />completion of all site construction plans. <br /> <br />11. The development portions of deed covenants shall be attached to and incorporated <br />into this PUD agreement to insure proper maintenance and architectural control <br />(Exhibit H). <br /> <br />12. The principle use of each unit lot within the PUD shall be a one level residential <br />townhome not exceeding 1,380 square feet in area, as approved in the architectural <br />plans dated March 12, 1997. Basements, covered porches and attached garages <br />are allowed; however, such areas are excluded from the above referenced <br />maximum square footage of the town home unit. <br /> <br />13. Covered porches, decks, and patios shall only be located at the rear of the principle <br />structure on each unit lot. <br /> <br />14. Garages shall be utilized for vehicle parking and shall not be converted to additional <br />storage or living space. <br />
