<br />both cases the ground was spongy and water soaked. The effort to remedy the problem <br />is definitely not working. <br /> <br />The city will review again. <br /> <br />2. Standing Water: In several of the areas around the perimeter of the development and <br />between units, there is standing water. It is not only unsightly, but unsanitary. The <br />land must be contoured so the water will flow appropriately. Much of the sod is dead or <br />dying from the standing water. <br /> <br />Generally, the townhome association would fill in settling soil in common areas after a <br />one-year cutoff. It needs to be investigated. <br /> <br />B. Soil Preparation and Grass Installation <br /> <br />I. Seeded areas: Some areas that were not sodded have been seeded with a spray foam <br />substance. The ground was not prepared properly. It was sprayed with foam containing <br />seed over rocks, twigs and the like. This application is not acceptable. The ground <br />must be prepared correctly and sodded. <br /> <br />The city believes that this is a dispute between the Association and the builder. However. <br />they will review again. <br /> <br />2. Sodded areas: In several sodded areas, particularly around the units, sod has been laid <br />with little or no ground preparation work. The result is that the sod has not rooted and <br />several areas are dying. Additionally, if you lift the sod, you will see washed out areas <br />underneath. <br /> <br />Same response as Bl, except the builder has voluntarily promised to resod where it has died. <br /> <br />c. Trees: Many trees that have been planted have died, others have never been planted <br />according to the approved plat as follows: <br />1. missing sugar maple tree at the southeast comer of the development, east of 187 Burke; <br />2. missing Austrian pine tree on the northeast side of 2121 Albemarie; <br />3. two missing Austrian pine trees between 2113 and 2109 Albemarle; <br />4. missing one tree of unknown size or kind between 2109 and 2105 Albemarle; <br />5. missing sugar maple, missing two Black Hills spruce trees and one autumn blaze maple <br />trees; <br />6. missing one ornamental tree between 2097 and 2098 Albemarle; <br />7. missing tree of unknown size or kind between 2100 and 2110 Albemarle; <br />8. missing three Black Hills spruce trees between four northern-most buildings; <br />9. two dead sugar maple trees must be replaced at the northwest comer of2155 <br />Albemarle; <br />10. missing Austrian pine along north side of 2155 Albemarle, on County Road B; <br />II. missing sugar maple tree at the northwest comer of 178 County Road B; <br />
